Terms and Conditions

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms, and "you" includes that business.

Quoteroam is an online cost estimating tool for builders, contractors and other construction professionals. It helps you enter project details, calculate estimated material, labor and other costs, and prepare quotes to share with your clients.

Estimates produced by the Service are based on the information you enter, pricing data, formulas and assumptions that may not reflect local prices, site conditions, building codes or market changes. They are for planning purposes only. You are solely responsible for:

• Checking the accuracy of every estimate and quote before you use or send it
• The prices, terms and scope you agree with your own clients
• Complying with building codes, permits, licensing and other laws that apply to your work

Quoteroam does not provide engineering, architectural, legal, tax or financial advice. We are not a party to any agreement between you and your clients, and we are not responsible for any cost overruns, losses or disputes that result from relying on an estimate.

To use most features, you need an account. You agree to:

• Give accurate, current and complete information
• Keep your login details confidential
• Tell us promptly at support@quoteroam.com if you suspect unauthorized use

You are responsible for all activity under your account, including activity by team members you invite.

Some features may require a paid subscription. If you buy one:

• Fees, billing cycle and features are shown at the time of purchase
• Subscriptions renew automatically until you cancel
• You can cancel at any time in your account settings, and cancellation takes effect at the end of the current billing period
• Fees are non-refundable except where required by law or stated otherwise at purchase
• We may change prices with at least 30 days' notice before your next renewal

Payments are processed by a third-party payment processor. We do not store your full card details.

"Your Content" means the project details, client information, pricing, files and other material you enter into or upload to the Service. You keep ownership of Your Content. You grant us a limited license to host, store, process and display it only as needed to operate and improve the Service for you.

You confirm that you have the rights and any permissions needed to enter Your Content, including your clients' personal information, and that it does not violate any law or anyone else's rights.

We may use aggregated, de-identified data (for example, average material costs by region) to improve the Service. This data does not identify you or your clients.

You agree not to:

• Enter false or misleading information, or use the Service to mislead your clients
• Use the Service for any unlawful or fraudulent purpose
• Scrape, copy or harvest data or pricing from the Service by automated means
• Resell, sublicense or share access to the Service outside your account
• Interfere with the security or operation of the Service
• Reverse engineer any part of the Service
• Impersonate any person or misrepresent your affiliation

The Service may include pricing data from, or links to, suppliers and other third-party services. We do not control them and are not responsible for their accuracy, content, products or privacy practices.

The Service and its content, including software, estimating formulas, pricing databases, templates, text, graphics and logos, are owned by or licensed to Pixeloddity LLC and protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. Quotes and estimates you create are yours to use with your clients.

If you send us ideas or suggestions, we may use them without any obligation to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that estimates, pricing data or calculations are accurate, complete or current, or that the Service will be uninterrupted, secure or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, PIXELODDITY LLC AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, INCLUDING LOSSES FROM UNDER-PRICED OR INACCURATE ESTIMATES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so they may not apply to you.

You agree to indemnify and hold harmless Pixeloddity LLC from any claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, Your Content, your misuse of the Service, or any agreement or dispute between you and your clients.

You may stop using the Service and close your account at any time. We may suspend or end your access if you violate these Terms, fail to pay fees, or if required by law. After your account ends, we may delete Your Content after a reasonable period, so export anything you need first. Sections that by their nature should survive termination will survive.

We may change or discontinue features of the Service at any time. We may update these Terms and will post the new version with a revised effective date. For material changes, we will give notice by email or in the Service. Continuing to use the Service after changes take effect means you accept them.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Fairfax County, Virginia, and you consent to their jurisdiction.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of our business.
